About the Malta Business Registry

The Malta Business Registry, established under Subsidiary Legislation 595.27, is responsible for the registration of new commercial partnerships, the registration of documents related to commercial partnership, the issuing of certified documentation including certificates of good-standing amongst others, the reservation of company names, the collection of registration and other fees, the publication of notices and the imposition and collection of penalties. The Registry also conducts investigations of companies and the keeping of the company and partnership register.

The Role

The eventual appointee will be appointed at a Head in Grade 4 level reporting to the Registrar (Chief Executive Officer) or to any other official to whom the Registrar/CEO’s authority is delegated and will be entrusted with responsibilities relating to the following duties which shall include:

  • Demonstrate a good understanding of Maltese and European legislation and provide the MBR with the required support regarding the interpretation of the assigned legal documentation;
  • Participate in ensuring that the MBR meets its obligations in terms of local legislation, EU directives and corporate governance requirements;
  • Drafting of legal documents and the preparation of Bills and Legal Notices, together with all the documentation that needs to be submitted to the Office of the State Advocate;
  • Demonstrate a good understanding and assist MBR’s Data Protection Officer in GDPR related work;
  • Familiar with Anti-Money laundering and Counter Terrorist Finance legislation including reviewing of documents/reports relating to evaluations carried out on Malta;
  • Keep abreast with developments, policies and procedures issued by EU institutions, the Government of Malta, its authorities and entities as well as organisations and constituted bodies;
  • Defending and representing the Registrar and/or MBR in Court Cases;
  • Liaise with the Agency’s in-house and/or outsourced Legal Procurators on a regular basis for the successful endeavour of all court cases;
  • Representing the Registrar and/or MBR in both local and international forums and also attending meetings relating to EU transpositions, both locally and abroad;
  • Enhancing enforcement methods and processes to improve regulatory compliance of commercial partnership, companies and other legal persons and promote the importance of transparency;
  • In charge of the drafting and reviewing of all contracts, legal documents and MOUs;
  • Contribute towards the achievement of the MBR’s by defining and executing a long-term vision for the Unit, focusing on MBR’s mission and vision;
  • Carry out training sessions, participate in panels and deliver presentations to all MBR’s stakeholders and the general public;
  • Managing the distribution of work, setting clear objectives, and ensuring that both individual and team targets are met;
  • Leading, mentoring, and supporting team members, ensuring their ongoing professional development and empowering them through effective delegation to ensure the smooth running of the team;
  • Ensuring close collaboration with the other Units of the MBR, in particular with Registry and Compliance Unit, and all management teams across the MBR to ensure seamless operations with stakeholders and ensure that proper legal guidance is given to all Units;
  • Preparing and managing resource requests, aligning staffing and budget needs with MBR’s priorities;
  • Managing training and performance appraisal processes in line with budgetary constraints.
  • Maintaining and updating the Uni policies and procedures as well as the standard operating procedure (SOPs);
  • Prepare reports to the Registrar/CEO and/or top management, as required;
  • Being an active member of the MBR’s Board of Management and in Selection Panels in line with the related provision of the Staff Handbook;
  • To handle responsibilities for budgeting in relation to this function; and
  • Establish KPIs for all staff within the designated section and supervise the delivery of the KPIs.
  • Any other task that the Registrar/CEO assigns from time to time;

Any other duties described above may change depending on the exigencies of the Legal and Enforcement Unit and/or the MBR.

Furthermore s/he will be expected to assist in other duties as may be directed from time to time by the Registrar/CEO or by any other official to whom the Registrar/CEO’s authority is delegated.

About You

We are looking for candidates who possess a University of Malta Degree in Legal (LL.D) academic qualification or an equivalent qualification in a relevant field of study at National Qualification Framework Level 7 or better, duly certified by the Malta Qualifications Recognition Information Centre (MQRIC)* or a widely recognised professional qualification at a comparable level; AND also possess a minimum of six (6) years working experience in a related area of which two (2) years in a Management Level Role (Internally from Senior Manager Grade upwards); OR

Candidates who possess a University of Malta Degree in Legal (LL.D) academic qualification or an equivalent qualification in a relevant field of study at National Qualification Framework Level 6 or better, duly certified by the Malta Qualifications Recognition Information Centre (MQRIC)* or a widely recognised professional qualification at a comparable level; AND also possess a minimum of seven (7) years working experience in a related area of which three (3) years in a Management Level Role (Internally from Senior Manager Grade upwards) ; OR

Candidates who at least possess twelve (12) years’ experience in a related area of which six (6) years in a Management Level Role (Internally from Senior Manager Grade upwards).

* It is the responsibility of applicants in possession of qualifications awarded by Universities and other similar institutions outside Malta to produce a recognition statement on comparability of qualifications issued by the Malta Qualifications Recognition Information Centre (MQRIC).
