Deputy Head in Grade 5 within the Legal and Enforcement Unit
About the Malta Business Registry
The Malta Business Registry, established under Subsidiary Legislation 595.27, is responsible for the registration of new commercial partnerships, the registration of documents related to commercial partnership, the issuing of certified documentation including certificates of good-standing amongst others, the reservation of company names, the collection of registration and other fees, the publication of notices and the imposition and collection of penalties. The Registry also conducts investigations of companies and the keeping of the company and partnership register.

The Role
The eventual appointee will be appointed at a Deputy Head in Grade 5 level reporting to the Head of the Legal and Enforcement Unit and the Registrar (Chief Executive Officer) or to any other official to whom the Registrar/CEO’s authority is delegated and will be entrusted with responsibilities relating to the following duties which shall include:
- Demonstrating a good understanding of Maltese and European legislation and providing the MBR with the required support regarding the interpretation of the assigned legal documentation;
- Acting as the primary deputy to the Head of Unit, assuming full responsibility for the Legal Unit’s operations in her absence and contributing actively to the MBR’s long-term legal and corporate strategy;
- Leading the drafting and reviewing of Bills, Legal Notices, and statutory instruments, and managing the high-level liaison with the Office of the State Advocate;
- Participate in ensuring that the MBR meets its obligations in terms of local legislation, EU directives and corporate governance requirements;
- Overseeing the legal implications of the MBR’s digitalization initiatives, ensuring that electronic registry systems, automated processes, and digital certifications are legally sound and future-proof;
- Serving as the lead legal authority on GDPR compliance, ensuring the Registry’s data-handling practices and the Register of Beneficial Owners (RBO) adhere to strict data protection standards;
- Formulating and directing the legal strategy for court cases involving the Registrar/MBR, and managing the performance of both in-house and outsourced Legal Procurators;
- Ensuring the MBR meets all obligations regarding EU Directives and Maltese legislation, specifically regarding AML/CFT frameworks and international transparency standards;
- Driving the enhancement of enforcement methods to improve the regulatory compliance of commercial partnerships and legal persons;
- Representing the MBR as a subject matter expert in local and international forums, particularly regarding EU transpositions and regulatory peer reviews.
- Representing and/or defending the Registrar in Court;
- Directing the Legal Unit’s staff by setting clear objectives, managing performance appraisals, and fostering professional development through effective delegation.
- Ownership of the Unit’s Standard Operating Procedures (SOPs) and internal policies, ensuring they are updated to reflect evolving legal landscapes.
- Ensuring seamless legal support for the Registry, Compliance, and IT Units to maintain a unified approach to stakeholder management.
- Preparing high-level reports, briefings, and KPIs for the CEO/Registrar and top management to facilitate informed decision-making.
- Assisting the Head of Unit in the drafting and reviewing of all contracts, legal documents and MOUs;
- Assisting the Head of Unit in managing the distribution of work, setting clear objectives, and ensuring that both individual and team targets are met;
- Assisting the Head of Unit in leading, mentoring, and supporting team members, ensuring their ongoing professional development and empowering them through effective delegation to ensure the smooth running of the team;
- Ensuring close collaboration with the other Units of the MBR, in particular with the Registry and Compliance Unit, and all management teams across the MBR, to ensure seamless operations with stakeholders and ensure that proper legal guidance is given to all Units;
- Assisting the Head of Unit in managing training and performance appraisal processes; and
- Any other task that the Registrar/CEO assigns from time to time;
Any other duties described above may change depending on the exigencies of the Legal and Enforcement Unit and/or the MBR.
Furthermore s/he will be expected to assist in other duties as may be directed from time to time by the Head of the Unit and/or the Registrar/CEO or by any other official to whom the Head’s or Registrar/CEO’s authority is delegated.
About You
- We are looking for candidates who possess a University of Malta Degree in Legal (LL.D) academic qualification or an equivalent qualification in a relevant field of study at National Qualification Framework Level 7 or better, duly certified by the Malta Qualifications Recognition Information Centre (MQRIC)* or a widely recognised professional qualification at a comparable level; AND also possess a minimum of five (5) years working experience in a in a Management Level Role related area of which three (3) years in a Management Level Role; OR
- Candidates who possess a University of Malta Degree in Legal (LL.D) academic qualification or an equivalent qualification in a relevant field of study at National Qualification Framework Level 6 or better, duly certified by the Malta Qualifications Recognition Information Centre (MQRIC)* or a widely recognised professional qualification at a comparable level; AND also possess a minimum of six (6) years working experience in a related area of which four (4) years in a Management Level Role; OR
- Candidates who at least possess eleven (11) years’ experience in a related area of which eight (8) years in a management level role.
* It is the responsibility of applicants in possession of qualifications awarded by Universities and other similar institutions outside Malta to produce a recognition statement on comparability of qualifications issued by the Malta Qualifications Recognition Information Centre (MQRIC). Applicants should do so preferably at application stage or otherwise at the preliminary interview should an applicant be selected for such interview.
